1. Agreement to Terms
By accessing or using Waffle ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Eligibility
You must be at least 13 years old to use Waffle. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that you have parental or guardian consent.
3. Account Registration
To use Waffle, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activity under your account
4. The QR Code Connection System
Waffle requires users to meet in person and scan QR codes to connect. By using this feature, you agree to:
- Only scan codes when physically present with another user
- Not share or distribute your QR code for remote scanning
- Not use automated tools to scan or generate QR codes
- Respect that QR codes refresh periodically for security
5. User Conduct
You agree not to:
- Use the Service for any illegal purpose
- Harass, bully, or intimidate other users
- Post content that is hateful, violent, or sexually explicit
- Impersonate others or misrepresent your identity
- Spam or send unsolicited messages
- Attempt to circumvent the in-person connection requirement
- Use bots, scrapers, or automated tools
- Interfere with the Service's operation or security
- Violate any applicable laws or regulations
6. Content
6.1 Your Content
You retain ownership of content you post on Waffle. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the Service.
6.2 Content Removal
We reserve the right to remove any content that violates these Terms or that we deem inappropriate. Content may also be removed if reported by a significant portion of your friends.
6.3 Content Responsibility
You are solely responsible for the content you post. We do not endorse or guarantee the accuracy of user-generated content.
7. Founding Friends
New users may add up to 5 "Founding Friends" from their phone contacts. This feature:
- Is only available within 7 days of account creation
- Requires the contact to already have a Waffle account
- Cannot be used after the initial period expires
- Does not replace the core in-person connection requirement
8. Moderation and Enforcement
We may take action against accounts that violate these Terms, including:
- Warning the user
- Removing content
- Temporarily suspending accounts
- Permanently terminating accounts
Accounts may be automatically flagged for review when reported by 10% or more of a user's friends.
9. Intellectual Property
The Service and its original content (excluding user content), features, and functionality are owned by Waffle and are protected by copyright, trademark, and other intellectual property laws.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR THE CONDUCT OF USERS OR THEIR CONTENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WAFFLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
12. Termination
You may delete your account at any time through the app settings. We may terminate or suspend your account for violations of these Terms. Upon termination, your right to use the Service will cease immediately.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
